Article 1 – General Provisions and Subject Matter
- These General Terms and Conditions of the Loyalty Programme (hereinafter: the “Terms”) govern the rights and obligations of participants in the loyalty programme named Back2YOUth (hereinafter: the “Programme”), which is implemented through Hipotekarna Banka’s payment card (Mastercard Youth Debit Card) and the mHB klik mobile application, in accordance with the applicable laws and regulations of Montenegro, in particular the Consumer Protection Act (“Official Gazette of Montenegro”, No. 12/2026) and the Payment Transactions Act (“Official Gazette of Montenegro”, Nos. 062/13 of 31 December 2013, 006/14 of 4 February 2014, 111/22 of 7 October 2022, 007/23 of 20 January 2023, 015/25 of 20 February 2025, 140/25 of 1 December 2025, and 103/26 of 16 July 2026).
- The Back2YOUth Programme is designed to reward regular customers of Hipotekarna Banka who make payments using the Hipotekarna Banka Mastercard Youth Debit Card and who have enrolled in the Programme via the mHB klik mobile application.
- The Programme shall run for 6 (six) months from the date of its official launch, which shall be announced by Hipotekarna Banka on its website and through the mHB klik mobile application. The exact start and end dates of the Programme shall be specified in a separate notice published no later than 7 (seven) days prior to the commencement of the Programme. Upon expiry of the aforementioned period, the Programme shall terminate, unless Hipotekarna Banka decides to extend it, in which case the Participants shall be duly informed in a timely manner.
Article 2 – Definitions
For the purposes of these Terms, the following terms shall have the meanings set out below:
- Organiser – Hipotekarna banka A.D. Podgorica, a legal entity responsible for organising and implementing the Back2YOUth Loyalty Programme, whose full name, registered office address and Tax Identification Number (TIN) are provided on the official website and in the mHB klik mobile application.
- Participant – a natural person who is a user of a Hipotekarna Banka payment card, meets the eligibility requirements for participation in the Back2YOUth Programme, has joined the Programme through the mHB klik mobile application, and has accepted these Terms.
- **Card** – the Hipotekarna Banka Mastercard Youth Debit Card used by the Participant to conduct transactions within the Programme.
- Loyalty Point (hereinafter: the “Point”) – a virtual unit of reward measurement awarded to the Participant based on transactions carried out using the payment card.
- User Account – the Participant’s personalised account within the Programme’s system, containing information on the Point balance and transaction history.
- Partner Establishment – a legal entity or natural person that participates in the Programme in cooperation with the Organiser as a participating or reward location.
- mHB klik Mobile Application – the official mobile application of Hipotekarna Banka through which the Participant enrols in the Back2YOUth Programme, monitors their Point balance, and uses the benefits of the Programme.
Article 3 – Eligibility Requirements for Participation in the Programme
Individuals who are eligible to participate in the Programme are those who:
- are at least 15 years of age. Persons aged 15 to 18 may participate in the Programme on the basis of the parent’s or legal representative’s general consent, which was duly signed and documented upon the opening of the account and issuance of the relevant Card;
- are holders of an active Hipotekarna Banka Mastercard Youth Debit Card;
- have enrolled in the Programme through Hipotekarna Banka’s mHB klik mobile application and completed the registration process;
- have accepted these Terms and the Organiser’s Privacy Policy.
Legal entities and entrepreneurs are not eligible to participate in the Programme, unless otherwise expressly approved in writing by the Organiser.
Article 4 – Enrolment in the Programme and Activation of the User Account
The Participant shall enrol in the Back2YOUth Programme exclusively through Hipotekarna Banka’s mHB klik mobile application by selecting the relevant option in the application and accepting these Terms electronically. For users who, for justified technical reasons, are unable to access the application, the Bank shall enable them to submit a request for activation directly at the Bank’s branches.
The User Account within the Programme shall be activated automatically immediately upon completion of the enrolment process in the mHB klik application. The Participant shall be notified of successful activation by email within 24 hours. The right to earn Points shall commence from the moment the account is officially activated. If activation is delayed for more than 24 hours due to a technical error in the Organiser’s system, the Participant shall be retroactively credited with Points for transactions made after the expiry of that period.
Each natural person may have only one User Account. In the event that duplicate accounts are detected for the same person, the Organiser shall automatically deactivate any subsequently opened accounts, while the primary account and the Points accumulated therein shall remain valid, unless fraudulent intent is established.
Article 5 – Earning Points
5.1 Point Value and Conversion Rate
Under the Programme, 1 (one) accumulated Loyalty Point shall have a fixed nominal value of EUR 1.00 (one euro) upon conversion and transfer of funds to the Participant’s account.
5.2 Point Accumulation Rule 1 – Off-Us Transactions
The Participant shall earn 0.02 Points for each EUR 1.00 spent on the following transactions:
- POS and e-commerce transactions made using the Mastercard Youth Debit Card
- Transactions made through a digital wallet using the Mastercard Youth Debit Card.
outside Hipotekarna Banka’s network (in Montenegro and abroad).
Validity Period: 1 September 2026 – 28 February 2027
Maximum number of Points per Account: 200 Points per month (combined limit for Rule 1 and Rule 2).
5.3 Point Accumulation Rule 2 – On-Us Transactions
The Participant shall earn 0.05 Points for each EUR 1.00 spent on the following transactions:
- POS and e-commerce transactions made using the Mastercard Youth Debit Card;
- Transactions made through a digital wallet using the Mastercard Youth Debit Card.
within Hipotekarna Banka’s network (on-us transactions);
Validity Period: 1 September 2026 – 28 February 2027
Maximum number of Points per Account: 200 Points per month (combined limit for Rule 1 and Rule 2).
5.4 Promotion 1 – Bonus for Active Users (September–November 2026)
A Participant who meets both of the following conditions in a calendar month shall receive a bonus of 20 Points:
- makes at least 3 (three) transactions using the Card during the calendar month; and
- spends a total of at least EUR 30.00 during the calendar month.
Validity Period: 1 September 2026 – 30 November 2026
Maximum Bonus per Account: 20 Points per month.
Total Promotion Budget Limit: EUR 40,000.
If the allocated budget is exhausted before the expiry of the validity period, the Organiser shall immediately suspend the Promotion and officially notify the Participants thereof via the mHB klik application and the Bank’s website, while all rights acquired up to the time of suspension shall remain fully protected.
5.5 Promotion 2 – Double Points on Promotional Day (December 2026 – February 2027)
Hipotekarna Banka shall designate one promotional day per week (e.g. Tuesday), on which increased Point values shall apply:
- 0.04 Points per EUR 1.00 for off-us transactions (double the amount under Rule 1);
- 0.10 Points per EUR 1.00 for on-us transactions (double the amount under Rule 2).
The Promotional Day shall be announced in advance via a push notification in the mHB klik application.
Validity Period: 1 December 2026 – 28 February 2027
Total Promotion Budget Limit: EUR 20,000.
For the purpose of awarding Double Points, only the date and time when the transaction is executed (authorised) at the point of sale shall be taken into account, and not the date on which the transaction is finally posted to the Bank’s system.
5.6 Excluded Merchant Categories (MCC)
The following transactions shall not qualify for the earning of Points under any Rule or Promotion, regardless of the type or channel of the transaction:
- 4829 – Quasi-Cash – Money Transfer
- 6010 – Financial Institutions – Manual Cash Disbursement
- 6011 – Financial Institutions – Automated Cash Disbursement
- 6012 – Quasi-Cash – Financial Institution – Goods and Services
- 6050 – Quasi-Cash – Financial Institution Member
- 6051 – Mastercard – Quasi-Cash – Merchant
- 6529 – Quasi-Cash – Remote Loading of Stored Value
- 6530 – Quasi-Cash – Remote Loading of Stored Value
- 6531 – Payment Service Provider
- 6532 – Payment Transaction – Member
- 6533 – Payment Transaction – Merchant
- 6534 – Money Transfer – Customer Financial Institution
- 6535 – Purchase of Value – Financial Institution Member
- 6536 – MoneySend – Domestic
- 6537 – MoneySend – International
- 6538 – MoneySend – Funding
- 6540 – POI financing transactions (excluding MoneySend)
- 7801 – Online gambling
- 7995 – Betting, including lottery tickets, casino chips, off-race betting and racetrack betting
- 9754 – Quasi cash – gambling, horse and dog racing, state lotteries
When paying at the point of sale or on the Internet, the merchant’s categorization depends solely on the activity code (MCC) registered by the merchant in the card system, which the Organizer cannot influence.
5.7 Point Lending
Points acquired according to Rule 1 and Rule 2 are credited to the User’s account no later than 5 (five) working days from the date of execution of the transaction, provided that the transaction is not the subject of a dispute or refund. Bonus Points from Promotion 1 are credited no later than the 10th of the following calendar month, after checking that the conditions have been met.
In the case that the completed transaction is reversed, that is, if the Participant returns the purchased goods/services and refunds the money to the account, the corresponding collected Points for that transaction will be automatically deleted from the User’s account. If the Participant has used those Points in the meantime, his Points balance may become negative.
Article 6 – Use and exchange of Points
Collected Points can be used for:
- transfer of funds to a payment card.
The minimum amount of Points required for conversion is 1 (one) point.
During the conversion and transfer of funds to the account, Points are rounded to the nearest whole number according to standard mathematical rules, while the remaining decimals are transferred and remain saved in the User’s account for the next calculation.
Points cannot be transferred between different User accounts, nor can they be used as a means of payment outside the Program.
Article 7 – Validity of Points
Points are valid until the end of the Program, i.e. no longer than 3 (three) months from the day they were posted to the Participant’s User Account. Upon completion of the Program, unused Points lose their validity, unless Hipotekarna banka specifies otherwise in a special notice. When using and exchanging Points for cash, the system will automatically first write off (spend) the Points that were collected first (FIFO method).
The balance of collected Points, as well as the exact amount and date of expiry of the Points that lose their validity first, will be transparently displayed to the Participant at all times within the mHB klik mobile application. In addition to the permanent display in the application, the Organizer will remind the Participant via push notification or SMS message of the upcoming expiration of Points at least 15 (fifteen) days before their expiration date.
Article 8 – Special promotions and bonus points
The Organizer reserves the right to periodically organize special promotional actions with an increased number of Points for certain categories of transactions, certain points of sale or in certain time periods.
Participants will be informed about all special promotions in a timely manner through the Bank’s website, push notifications in the mHB klik mobile application, SMS messages or e-mails, no later than 3 (three) working days before the start of the promotional action.
Points from special promotions are subject to the same rules of use and validity period as standard Points, unless the terms of a particular promotion provide otherwise.
Article 9 Rights and obligations of the Participant
The participant is required to:
- keeps the Card and personal data and immediately informs the Organizer in case of loss, theft or unauthorized use of the Card;
- regularly checks the status of his User Account;
- notifying the Organizer of a change in contact information (address, e-mail, telephone) within 15 days of the occurrence of the change;
- use the Points exclusively in accordance with these Terms.
Any abuse of the Program, including simulating transactions, unauthorized transfer of Points and any other action that undermines the integrity of the Program is prohibited.
Article 10 – Rights and obligations of the Organizer
The organizer is obliged to:
- Provide the Participant with access to the User Account and insight into the balance of Points;
- promptly informs the Participants about changes to the Program, Terms or prize catalog;
- stores the Participant’s personal data in accordance with the current regulations on the protection of personal data.
The Organizer reserves the right to change the conversion rate of Points, the conditions for activation, prizes and partner facilities, with prior notification to the Participant at least 30 (thirty) days in advance via the website or electronic communication channels.
Changes to the terms of the program will apply exclusively to transactions made after the entry into force of the new terms. The points collected by the Participant before the changes came into force will be converted and used under the conditions that were valid at the time of their acquisition.
Article 11 – Personal data protection
The Organizer processes the personal data of the Participants in accordance with the Law on Personal Data Protection of Montenegro (“Official Gazette of Montenegro”, no. 79/08, 70/09, 44/12 and 22/17).
The legal basis for the processing of the Participant’s basic data (name, surname, Card number, data on transactions carried out within the Program rules and the balance of Points) is the execution of the Contractual relationship defined in these Terms, and for the purpose of managing the Loyalty Program, calculating and awarding Points.
As part of this Program, the Bank does not perform profiling of consumer habits, automated data processing, or advanced market analysis.
Informing the Participant about the status of Points, technical information and benefits of the Program (such as promotional days or the upcoming release of Points) is done via push notifications in the mHB click application or SMS messages. For sending general marketing offers, the Bank uses the consent for direct marketing that the Participant (ie his legal representative for persons under 18 years of age) voluntarily gave when signing the Request for activation of services at the Bank’s office. The participant has the right to withdraw the given consent for marketing at any time, which does not affect his right to continue participating in the Loyalty Program and collect Points according to the regular rules.
Personal data is collected solely for the purpose of managing the Loyalty Program and communicating with the Participant, and may not be used for other purposes without the express consent of the Participant.
The participant has the right to request inspection, correction or deletion of his personal data at any time, by sending a written request to the Organizer’s address or by e-mail to the address specified in the mHB click application / the Bank’s website.
Data collected specifically for the needs of this Program are deleted within 30 days from the date of termination of the Program or deactivation of the account, except for transactional and financial data that the Organizer is obliged to keep within the prescribed time limits in accordance with the Law on Payment Transactions and the Law on Prevention of Money Laundering.
Article 12 – Exclusion from the Program
The Organizer may exclude the Participant from the Program, with the cancellation of all collected Points, in the following cases:
- determined misuse of the Program or Card;
- submission of incorrect or false data during registration;
- violation of the provisions of these Terms;
- a final judgment determining the Participant’s responsibility for the fraudulent use of payment instruments.
In case of suspicion of abuse, the Organizer will temporarily suspend the User Account and notify the Participant without delay via mobile application or e-mail, specifying the disputed transactions. The participant has the right to submit evidence of the regularity of transactions (fiscal invoice/certificate of trade) within 8 (eight) working days from the date of receipt of the notification. If the Participant does not submit evidence or the abuse is undoubtedly established, the Organizer makes a decision on the permanent exclusion and cancellation of Points acquired through disputed transactions.
Article 13 – Withdrawal from the Program
The participant has the right to cancel participation in the Program at any time, without giving any reason, via the mHB klik mobile application, by contacting the e-mail kartice@hb.co.me or directly at the branch office.
Upon receipt of the request, the Organizer is obliged to immediately deactivate the User Account.
On the day of account deactivation, all remaining collected Points are temporarily suspended (frozen) and cannot be used.
Within 30 (thirty) days from the day of deactivation, the Participant can renew participation in the Program via the application or e-mail, which reactivates the suspended Points with the original validity period. If the Participant does not renew participation within 30 days, the User Account is permanently deleted, and the suspended Points permanently lose their value without the possibility of refund.
Article 14 – Changes and termination of the Program
The Organizer reserves the right to change or suspend the Program at any time, with prior notification to the Participant through a notification in the mHB klik mobile application and/or electronically, no later than 30 (thirty) days in advance.
In case of a complete cessation of the implementation of the Program, Participants stop collecting new Points on the day specified in the notice of termination. The Organizer is obliged to enable the Participants to exchange and use the Points collected until then within a period that cannot be shorter than 90 (ninety) days from the day of the official termination of the Points collection, in accordance with the validity periods of the Points defined in Article 7 of these Terms.
Article 15 – Settlement of disputes
In the case of a dispute arising from participation in the Program, the Participant may submit a complaint to the Organizer in writing at any office or by e-mail. The organizer is obliged to respond to the objection in writing, namely:
- within 8 (eight) days from the day of receipt of a complaint related to the rules of the Loyalty Program and the collection of Points, in accordance with the Law on Consumer Protection;
- within 15 (fifteen) working days from the date of receipt of the complaint if the subject of the complaint is the execution of a payment transaction by Card, in accordance with the Law on Payment Transactions.
If the Organizer does not respond within the prescribed period or the Participant is not satisfied with the answer, the Participant can submit a complaint to the Central Bank of Montenegro (for payment transaction issues), the Directorate for Inspection Affairs or initiate proceedings before the competent court in Podgorica.
The law of Montenegro applies to these Terms.
Article 16 – Final Provisions
These Terms and Conditions enter into force on the day they are published in the mobile application mHB klik and on the website of Hipotekarna banka, and they apply to all Participants who joined this cycle of the Program.
Access to the Loyalty Program and activation of the User Account are not possible without the explicit and active acceptance of these General Conditions by the Participant in electronic form, within the mHB klik mobile application. The electronic confirmation of acceptance of the Terms is permanently stored in the information system of the Organizer as evidence of the concluded contractual relationship.
These Terms replace all previously published versions of the General Terms and Conditions of the Organizer’s loyalty program for this category of cards.
